Alvin C. Monshower, Jr.

Al is the senior partner of the law firm of Monshower, Miller & Magrogan, LLP, located in Ellicott City, Maryland. Al was a partner in the law firm of Cable, McDaniel, Bowie & Bond, as well as a partner in the law firm of McGuire, Woods, Battle and Booth until forming his own firm in 1992. He is past Director of Governmental Affairs and Executive Vice President of the Greater Baltimore Board of REALTORS®. Al graduated from the University of Kansas in 1969 with a B.A. degree in Political Science and, in 1980, graduated from the University of Baltimore School of Law with a J.D. degree. At the University of Kansas, Al was designated as Distinguished Military Graduate and was Commandant of the Corps of Cadets (Army R.O.T.C.). At the University of Baltimore School of Law, Al was a member of the University of Baltimore Law Review.

Al has acted as general legal counsel for the Maryland Association of REALTORS®, Inc. since February,1984.

Al is also general legal counsel for the Carroll County Association of REALTORS®, Inc.; the Coastal Association of REALTORS®, Inc.; the Frederick County Association of REALTORS®, Inc.; the Harford County Association of REALTORS®; the Howard County Association of REALTORS®, Inc., Mid-Shore Board of REALTORS, Inc. and the Southern Maryland Association of REALTORS®, Inc.

Al is special legal counsel for the Sussex County Association of REALTORS®, Inc. in Delaware.

Al is also special legal counsel to the Greater Capital Area Association of REALTORS®, Inc.; and the Prince George’s County Association of REALTORS®, Inc. on Code of Ethics and Arbitration procedures.

Al has also acted as special counsel to the Greater Baltimore Board of REALTORS® on contract and addenda forms as published by the Regional Forms Committee and has acted as special counsel to the Metropolitan Regional Information Systems, Inc. (MRIS) on multiple listing policies of the National Association of REALTORS®.

Al also acts as general counsel for Mid-Atlantic Realty Services, Inc. with respect to SentiLock lockbox services on behalf of Greater Baltimore Board of REALTORS®, Inc., the Carroll County Association of REALTORS®, Inc., the Harford County Association of REALTORS®, Inc. and the Howard County Association of REALTORS®, Inc.

Al is also designated counsel in Maryland by the National Association of REALTORS® for the enforcement and protection of the NAR REALTOR® trademark.

Al’s practice is devoted exclusively to real estate brokerage law, real estate trade association law, administrative law and defense litigation on behalf of real estate brokers and salespersons. He practices statewide and represents brokers and licensees before the Maryland Real Estate Commission, the Maryland Human Relations Committee, HUD and in civil litigation.

Monshower, Miller & Magrogan, LLP is the Maryland designated firm for defense representation of REALTORS® by multiple national errors and omissions insurance companies.

Al implemented the Maryland Legal Hotline on behalf of the Maryland Association of REALTORS® in 1986 and provided Hotline services to REALTORS® for 19 years, until the Hotline was transferred to the Maryland Association of REALTORS® for staffing by in-house legal counsel. Al also assisted the Pennsylvania Association of REALTORS® in forming its own Legal Hotline program.

Al has been a member of the American Bar Association, the Maryland Bar Association, and the Real Property and Probate Division of both the American Bar Association and Maryland Bar Association and has served on the ABA Subcommittee on Dual Agency and Buyer Brokering.

During his representation on behalf of REALTORS® and REALTOR® trade associations, Al:

  • was awarded a bill signing signature pen by then-Governor Harry Hughes for his involvement in the enactment of the Maryland Condominium Act;
  • drafted the Maryland Stigmatized Property Act;
  • drafted the first provisions of the Maryland Real Estate Brokers Act on agency disclosure;
  • over the period of three years, drafted multiple versions and was instrumental in the enactment of the Real Estate License Law Reform Act which took effect on January 1, 1999 and which remains the current law in Maryland;
  • drafted the Commercial Real Estate Broker License Lien Law Act as enacted by the Maryland General Assembly;
  • drafted a comprehensive Chairperson’s Handbook; Grievance Committee Handbook; Guide for Hearing Panel Members and Board of Professional Standards Handbook for use in Code of Ethics and Arbitration Hearings before local Boards and Associations of REALTORS®.
  • was engaged by the Chief Judge of the Maryland Office of Administrative Hearings to conduct a full day training program to Administrative Law Judges on the proper conduct of hearings involving real estate licensees in hearings before the Maryland Real Estate Commission; and
  • was engaged by the American Real Estate License Law Officials (ARELLO) to conduct a comprehensive class on ethics issues in hearings by State Real Estate Boards and Commissions in the conduct of hearings involving real estate licensees.

Al was a GRI instructor for the Maryland Association of REALTORS® for over twenty years. Al is also a member of the Maryland Real Estate Educators Association and is a frequent speaker and continuing education instructor on real estate brokerage law and risk reduction and instructs numerous such courses annually.

Al also instructs annual Local Board and Association of REALTORS® leadership training and instructs annual Local Board and Association of REALTORS® Professional Standards training to members of the Grievance Committee, Professional Standards Committee and Board of Directors, as well as a training program on the drafting of Ethics Decisions.

In 2011, the Maryland Real Estate Commission adopted Al’s comprehensive course outlines as the required course outlines on three mandatory courses now required by the Maryland Real Estate Commission on the topics of Agency-Residential; Agency-Commercial; and Broker, Manager and Team Leader Supervision Obligations. Al was one of three individuals designated by the Maryland Real Estate Commission to conduct required training of all instructors to teach these three courses for continuing education credit.

Al’s article entitled “Who Does the Real Estate Licensee Represent – Unmasking the Agent’s True Identity” was published in the April, 1986 issue of the Maryland Bar Journal. Al has twice updated Chapter 1 (Beginning the Sale of Residential Real Estate) of the 845-page publication of the Maryland Institute for Continuing Education of Lawyers, Inc. titled Residential Real Estate Transactions (last revised 2005, Fourth Edition).

Al is the recipient of the Omega Tau Rho medallion from the National Association of REALTORS® in recognition of his services to REALTORS® and their respective Boards and Associations.

Al is a former U.S. Army combat airborne infantry captain and served with the 82nd Airborne Division prior to his deployment to serve in the Republic of Vietnam from August, 1970 to August, 1971, for which service, he was awarded the Bronze Star and the Army Commendation Medal.
